With renewable energy sources set to generate more than US$7.5 trillion in global investment by 2040 (according to Bloomberg), the volume of renewables disputes is also expected to increase – particularly given changing regulation in this sector. In addition, the traditional energy and resources sectors continue to be a hotbed for international disputes.
We explore developments which present key opportunities and challenges in the sector, as well as risk mitigation strategies and measures which can be put in place to protect foreign investments in the event of a dispute. We also address the advent of third party funding in Hong Kong, which is consistent with the trend towards increased third party funding in international disputes.
